Penalties for Drug Possession and Distribution
Simple possession Possession of marijuana, even smaller quantities or residue of marijuana is likely to be considered a Schedule III or Schedule IVa misdemeanor offense. Simple possession of drug paraphernalia is also a misdemeanor. If convicted for possession of marijuana, in addition to other penalties, you will lose your driver's license for six months. With effective defense, you may be able to get a restricted license.
Possession of heroin, cocaine or methamphetamine (meth) is considered a Schedule I or Schedule II felony offense. In addition to potential jail time and financial penalties if convicted, you will lose your driver's license,. as you would with a Schedule III or Schedule IV misdemeanor drug offense.
If you have larger quantities of drugs, you may be charged with distribution or possession with intent to distribute (PW/ID). If convicted, this charge brings a mandatory minimum of five years in jail up to 40 years.
Drug Offenses Diversion Programs
For adults and juveniles facing drug charges for the first time, the 251 Disposition Program may be an option. In a sense, this diversion program is a plea deal with prosecution. In exchange for pleading guilty, you will be placed on probation and your driver's license will be suspended. You will be required to participate in community service and to make restitution for any financial damages. The court will later revisit your case to determine if you met the terms of your probation. If so, it has the option to dismiss the case and the charges.
